
Press release – The Ombudsperson published Ex-Officio Report No. 468/2022 with regard to state’s positive obligations to protect the child from violence
Prishtinë, 3 April 2023- The Ombudsperson, within the scope of exercising his legal powers and responsibilities, today published Ex-Officio Report with Recommendations No. 468/2022, concerning state’s positive obligations to protect a child from violence.
The case has been initiated Ex- Officio with intention of drawing attention of public institutions with regard to positive obligations of the state concerning protection of a child from violence. Simultaneously, this Report evaluates how effective, reasonable and prompt were actions taken by the competent state institutions concerning protection of a child from violence, pursuant to the Constitution of Republic of Kosovo, laws and other international instruments.
The Ombudsperson, after reviewing the relevant legislation, international instruments, case documents, information and data in its possession, deems that in this particular case there had been infringement of human rights and fundamental freedoms, namely a violation of positive obligations of the state to protect the child from violence.
The Ombudsperson finds that the responsible authorities were aware of the danger threatened to the child and failed to take all reasonable measures to protect him.
In respect to the given case, the Ombudsperson addressed relevant recommendations to: Kosovo Prosecutorial Council, Kosovo Police, Ministry of Internal Affairs, Ministry of Finance, Labor and Transfers, Kosovo Forensic Agency, the Institute of Forensic Medicine, the Municipality of Prishtina and the Center for Social Work.
