Press release, Report with recommendations, Case No. 717/2019, Veton Elshani et al

 May 26, 2020, Prishtinë – The Ombudsperson, pursuant to his constitutional and legal mandate, today has published the Report with regard to the case No. 717/2019, which was submitted to responsible authorities. Report concerns the lack of effective investigations and violation of the dignity of a relatively large number of under investigation Police Officers. The Report comes as logic outcome of accomplished investigations based on complaints of several Police Officers against the Police Inspectorate of Kosovo and the State Prosecution, regarding allegations on violations of a wide range of fundamental human rights and freedoms guaranteed by the Constitution, by international instruments as well as applicable Laws.

Report assesses the effective accomplishment of the rights of Police Officers who have acquired the status of “KLA War Invalid“, in connection with their facing with a deep ineffective investigation, discriminatory approach, violation of Article 6 of the Convention, with the lack of effective legal remedies, followed in continuation with violation of presumption of innocence and violation of the right to personal data protection.

The Report ascertains violation of the rights of under investigation persons and recommends that the State Prosecution and the Police Inspectorate of Kosovo, in accordance with the powers and legal authorizations, end investigations as soon as possible with regard to the case of Police Officers subject of this Report, so that the case receives a clear conclusion, either by filing an indictment and addressing of the case to the Court, or by ceasing of investigations.
