The Ombudsperson published two Reports regarding the failure of Privatization Agency of Kosovo to enforce the decisions
The Ombudsperson of Republic of Kosovo has published two separate Reports with Recommendations regarding the failure of Privatization Agency of Kosovo (PAK) to execute decisions.
The purpose of these two Reports is to draw attention of Kosovo Privatization Agency (PAK) regarding the need to undertake appropriate actions on enforcement of final decision of the case No. PRZ004-0042, of the date 28 June 2011, as well as enforcement of final decision of the case No. PRZ004-0054, of the date 28 June 2011 without further delays.
These Reports are grounded on individual complaints lodged by the complainants and are founded on facts and proves submitted by them as well as on the case files on possession of the Ombudsperson Institution (OI) regarding delay of the procedure on execution of these decisions.
Ombudsperson’s competency as per handling of these cases is based on Article 135, paragraph 3, of the Constitution, as well as Law No. 05/L-019 on Ombudsperson, Article 18 paragraph 1.2.
Based on facts gathered and legal analyses conducted regarding each case separately, the Ombudsperson, in the capacity of recommendation provider, commencing from legality enforcement principle, good intention to improve the work and increase the level of lawfulness on execution of final decisions as well as for a legal solution of this problem, in compliance with Article 135, paragraph 3 of the Constitution of Republic of Kosovo observes as reasonable to recommend to the Privatization Agency of Kosovo (PAK) :
To undertake immediate measures to enforce the final decision of the case, No. PRZ004-005, of 28 June 2011 as well as of the case No. PRZ004-0054 of 28 June 2011.
Full Ombudsperson’s Reports relating to Complaint No. 113/2016 and Complaint No.114/2016, regarding the failure to enforce decisions by PAK in the case No. PRZ004-0042, of the date 28 June 2011 and on case No. PRZ004-0054, of the date 28 June 2011, has been addressed to Mr. Petrit Gashi, presiding and director of Privatization Agency of Kosovo, on June 15, 2016.
Pursuant to Article 132, paragraph 3 of the Constitution of Republic of Kosovo and Article 28 of the Law on Ombudsperson No.05/L-019, the Ombudsperson awaits to be informed on actions planned to be undertaken as a response to the preceding Recommendation in this Report, within reasonable time frame, but no later than 16 August 2016.
