Ombudsperson’s response towards statement of Kosovo Prime Minister
12 January 2015, Prishtine– the Prime Minister Isa Mustafa, has been publically pronounced via Facebook, through which he declared that Ombudsperson’s announcement on Minister Jablanovic’s statement is “political estimation”
Let us remind the Prime Minister that the Law on Ombudsperson, article 16, point 1.3, foresees that one of Ombudsperson’s responsibilities is to “provide information about human rights and make efforts to combat all forms of discrimination through rise of awareness, especially through information and education as well as through the media “.
Expression “beast” was a part of Milosevic’s chauvinistic and hatred state apparatus campaign towards specific ethical group. When the Ombudsperson condemns publicly use of this phrase, actually expressed by a Kosovo Republic government member, he does not deal with “estimation of political statements”, but exactly accomplishes the work entrusted to him “ to combat all forms of discrimination […] through media“ and fulfills the promises and the oath given to the citizens and in front of the law.
It is very ironically the fact that Prime Minister Mustafa intents to counsel the Ombudsperson in accomplishing his liabilities while he himself has no idea, willingness or the carriage to accomplish his own responsibilities and liabilities, as the Head of the Government. Not undertaking any measure against minister Jablanovic is an evidence of such failure. On the other hand no intrusion is permitted on Ombudsman’s professional work from anybody, even from Prime Minister Mustafa.
Attempts of Prime Minister Mustafa that reactions towards Minister Jablanovic’s statements to deflect to another debate on “involvement in government of Serbs born or those living in Kosovo” are intentional and purposely elude, as well as cynical at the same time.
The Ombudsperson has never repudiated the right of Kosovo Serbs to serve people. On the contrary the Ombudsperson salutes participation of any community, including Serbian community, within the Government as well as in other grounds in Kosovo, but at the same time raises his voice when this is not done in compliance with the Constitution and the Law. For the Ombudsperson it is unacceptable and intolerable that a government member, belonging to any community, regardless minority or majority, rejects independency and sovereignty of Republic of Kosovo. There is no democratic nation in the world that will accept to be represented from somebody that negates the existence of the state to which it should serve. People of Republic of Kosovo are not and should not be different in this direction.
When giving explanation regarding his statement, Minister Jablanovic didn’t even make an apology for the hate language used by him but went even further. He once again repeated the discriminatory and aggressive expression “beasts”. Moreover, the burden of the guilt has been assigned to NATO forces, making it responsible for all victims and missing persons during the War in Kosovo, attempting deliberately to negate actual facts, legally and internationally recognized war crimes performed in Kosovo by Serbian state.
The Ombudsperson demands from the Prime Minister of Republic of Kosovo to undertake actions envisaged by the Constitution and the Law, to immediately discharge Mr. Jabllanoviq from every position in the Institutions of the Republic of Kosovo, as per use of hate language towards a certain group of people as well as due to rebuff of the Kosovo Republic State.
