3 October 2013 –Concerned by the current state and the information provided by media regarding landslide in Arbëria area, the Ombudsperson expresses his apprehension regarding infringement of the right in secure environment and healthy life, freedom of movement and property right in that part of Prishtina area.

Prior obtaining the information regarding this case OI associates have monitored continuously the situation and demanded from the Municipal Inspectorate information regarding this intervention into the environment without any criteria, area in which constructions were ongoing even in late hours and during the weekends.
The Ombudsperson has exposed his concerns several times regarding landslide, followed by the damage of the public and private property, but no concrete measures have been taken by the competent bodies. The situation created, among other things, is a consequence of a chain of legal violation during constructions done not solely in this location and not solely in Prishtina.
Another great concern is the situation created in the Secondary school “ 28 Nëntori” after extensive rains of these days. The fact that roof leaking is occurring in the newly constructed school and the responsibility is being denied from everyone, puts each of us on dilemmas: Are public authorities in Kosova accountable towards their citizens? Do they hold responsibility for the failures in administration and expenditure of public money?
Landslide in Arberia area and making functional the building of Secondary school “28 Nëntori” without fulfillment of foreseen construction criteria, are not the only cases in Kosova. Regardless of violation of public safety and a chain of other citizen’s rights, no measures have been taken from the competent authorities to rectify the situation created as well as to identify and take measures towards responsible persons.
Since no one admits and finds himself responsible for such failures, which have grave consequence for freedom, security, public and private property, the Ombudsperson demands from the judiciary, especially from the prosecution, to undertake all procedures foreseen by law for identification and bringing before the justice all responsible persons for these issues.
