Monitoring of Correctional Centre in Dubrave
26th of April 2013- the Ombudsperson Institution (OI) within its constitutional and legal mandate is obliged to monitor and protect human right and freedom from illicit actions or inactions of public authorities. Simultaneously, OI in the scope of its work and with intention to avert torture cases and inhuman treatment as well as enable direct communication and access to detainees, perform visits on regular bases in all prisons and places where people are deprived from liberty.
Alternatively, there is Optional Protocol to the International Convention against Torture (OPCAT) that predicts establishment of National Mechanisms for Torture Prevention (NMTP) which foresees commencing of visits on regular bases in all premises of public institutions where human liberty is limited. This means that institutions such as prisons, detention centers, police stations, psychiatric hospitals etc. will become the subject of permanent inspection with the aim to improve and respect continuously treatment standards of people detained in those premises.
In order to enable establishment of NMTP, in May 2011, OI has signed a Memo with Kosovo Rehabilitation Centre for Torture Victims (KRCTV) and Council for Defense of Human Rights and Freedoms (CDHRF) which foresees establishment of Joint Monitoring Board. This Board will monitor independently the premises where the people are put in custody. Such visit took place on 26th of April 2013 in Dubrava prison. Inspection of premises where people deprived of liberty are placed as well as hygienic conditions, food etc. took place on this occasion. Findings from this monitoring are summarized and based on them recommendations have been drafted for Kosovo Correctional Service and relevant institutions.
