Media release – Opinion of the Ombudsman regarding the expropriation process in the municipalities of Leposaviq and Zubin Potok of the Republic of Kosovo
Pristina, June 21, 2024 – The Ombudsman has published an Opinion regarding the expropriation process in the municipalities of Leposaviq and Zubin Potok of the Republic of Kosovo.
This Opinion came as a result of complaints from the residents of the municipalities of Leposaviq and Zubin Potok, who complained about the way this expropriation process was developed.
The People’s Advocate, taking into account the fact that a judicial procedure has been initiated for this matter, has not been released in merit assessment, but only presents his views in view of the protection of the right to property, as a human right guaranteed by the Constitution of Republic of Kosovo.
In this case, the People’s Advocate has observed that the decisions issued before and during the expropriation process did not have the appropriate clarity regarding the legitimate purpose for which the expropriation was made and this caused the condition not to be fully fulfilled legal for making known the lawful public purpose.
The People’s Advocate has pointed out the positive obligation of the institutions of the Republic of Kosovo to undertake all actions in the direction of clarifying the legitimate purpose and public interest, so that the intervention in the owners’ properties, for the purposes of expropriation, are clear. visible and permissible.
In addition to the argument highlighted above, the People’s Advocate has noted that the Government and the Ministry of Environment, Spatial Planning and Infrastructure (MMPHI) have developed other procedural actions related to the issue of expropriation in the municipalities of Leposavic and Zubin Potok, issuing decisions on the announcement of those areas of special interest, the adoption of other follow-up decisions, the holding of public hearings and the issuing of preliminary and final decisions, these actions are based on the Law on Expropriation of Real Estate.
